The Eviction Process: Step by Step
While the exact process can vary by state, the steps typically include:
- Notice of Default or Breach
When rent goes unpaid or a lease term is violated, a formal notice is sent, usually a “five-day notice.” This provides the renter with time to pay or resolve the issue before legal action begins. - Communication and Resolution Window
Between the notice and any court filing, property managers work actively to contact the resident. During this period, renters can often avoid eviction by paying outstanding balances, resolving lease violations, or arranging a move-out agreement. - Filing for Eviction (Forcible Detainer)
If the issue remains unresolved, the case may be sent to an attorney and filed in court. Hearings are typically scheduled within a week or two, giving residents another opportunity to settle before judgment. - Court Hearing and Judgment
If the renter appears in court and resolves the issue or reaches an agreement, eviction can be avoided entirely. If not, the judge may issue a judgment allowing the landlord to regain possession of the home. - Lockout and Property Repossession
